Terms and Conditions

You the ‘Client’ are a Commercially Important Person (CIP) to Opulence in Travel

Please read the following terms and conditions carefully. You must be 18 years of age or older to make a booking. It is important you understand and agree with the following terms and conditions. Following your engagement with the Opulence Lifestyle Group Limited, trading as Opulence in Travel, you will be known as an Opulence in Travel ‘Client’ and will be treated by Opulence in Travel as a Commercially Important Person.

Booking

Opulence in Travel will Collaborate, Create and Customize with the Client to provide a bespoke proposal outlining the Property and additional services that are included and any terms that differ to the terms as outlined below. Property rentals, also referred to as Villa rentals, will be checked for availability by Opulence in Travel with the Property owner prior to issuance of the proposal, unless otherwise stated, and in many cases the Property can be placed on hold for 2 working days, however booking confirmation can only be guaranteed once deposit and/or payment has been received by Opulence in Travel.

Following payment confirmation the Client will receive a booking confirmation and within 10 working days a full and detailed bespoke itinerary will be provided to the Client outlining the Property details, destination details and suggestions and/or bookings that have been arranged on behalf of the Client. By making payment the Client agrees to all Terms and Conditions as outlined herein and enters into a Rental Agreement with the Villa owner, whereby Rental Agreement terms are outlined in the Property’s terms and conditions that are available on each Property’s website.

Payment

When the Client makes a booking request, the Client must make the appropriate deposit payment for the Property requested and any additional services to the Opulence in Travel within 2 working days of Property availability confirmation and bespoke itinerary provided. Client’s should provide payment advice from the bank after any payments are made. The following deposit payment must be received by Opulence in Travel

For bookings beginning more than 60 days (90 days for peak season bookings) after the date of the booking request – a deposit of 50% of the total rental amount and additional services is payable to confirm the booking

For bookings beginning 60 days or less after the date of the booking request – 100% of the rental amount plus any additional services is payable as a deposit to confirm the booking
If the required deposit payment is not received within the 2 working day period, Opulence in Travel reserves the right to void the Client’s booking request, which will subsequently be informed to the Villa Owner.

Where a 50% deposit applies to the booking, the Client must pay the remaining 50% balance not less than 60 days (90 days prior in Peak season) before the scheduled arrival date.
All payments must be made in US Dollars, unless otherwise agreed with Opulence in Travel and must be made in accordance with Opulence in Travel’s payment instructions as set out in the Client’s bespoke proposal.

If payments are not made on or before the due dates as required herein, the Villa Owner or Opulence in Travel, may cancel the booking hold on the villa and any additional services that were requested. Cancellation charges may apply as detailed below.

Note: For hotel bookings, 100% of the booking amount must be paid in order to confirm the room/s.

Cancellations

If the Client wishes to cancel a confirmed booking, written notice by email of the cancellation must be sent to Opulence in Travel. All cancellation notices received by Opulence in Travel will be acknowledged by email.
Cancellation of a booking includes but is not limited to:

  • Cancellation of one or more days of a booking
  • An amendment of a booking so that none of the dates of the booking once amended fall within the same dates that originally constituted the booking;
  • Failure of all guests to provide the required documentation on arrival (eg. Passports or suitable identification); and
  • Attempt by the Client, their party or visitors to hold an event at the Property in breach of these Terms and Conditions or breach of any rules applicable to the Client’s chosen Property.

In the event that the Client cancels a confirmed booking, the following cancellation fees will generally apply:

  • 25% of the total rental amount will be forfeited if the cancellation is made more than 180 days before the start of the rental period
  • 50% of the total rental amount will be forfeited if the cancellation is made between 90-179 days before the start of the rental period
  • 100% of the total rental amount will be forfeited if the cancellation is made between 1 and 89 days before the start of the rental period.
  • The applicable amount will be deducted from the deposit and moneys paid, and Opulence in
  • Travel will refund any remaining balance to the Client.
  • Some Rental Properties may have different cancellation terms which will be informed to the Client during the booking process

Security Deposit

A security deposit may be payable directly to Opulence in Travel, the Villa Owner or Owner’s representative in advance or upon arrival at the Property. Any security deposit requirements will be informed to the Client during the booking process. Access to the Property may be refused if the security deposit is not paid in full. Security deposit payment methods differ in each Rental Property but typically can be made by wire transfer in advance in USD or paid in cash on arrival.

The security deposit will normally be refunded at the end of the rental period, after deducting:

  • all additional expenses incurred on the Client’s behalf (e.g. additional charges for goods, services and staff which have not been directly paid by the Client, and telephone and internet charges, if applicable) and
  • the cost of replacement or repair for any loss or damage to the Property or its surrounds or contents caused during the Rental Period. If this cost cannot be reasonably determined prior to the Client’s departure, the Villa Owner or the Owner’s Representative is entitled to withhold a reasonable estimate from the Client’s security deposit, and will return any balance to the Client as soon as possible after the actual cost has been determined.

Additional costs

The cost of electricity, mains water, cleaning and garden supplies, and local taxes are included in rental rates, unless otherwise stated. There are generally no additional costs, surcharges, taxes, staff salaries, or management fees above the price quoted unless otherwise stated on the Opulence in Travel website or in the Client’s bespoke proposal. If the information in any of these is inconsistent, the most recently issued terms will prevail.

Typically telephone and internet charges and provisioning costs will be the Client’s responsibility. Gratuities for house hold staff are encouraged and normal, but are left entirely to the Client’s discretion.

Arrival / Departure times

Typical check-out and check-in times are 12:00 noon and 3:00pm respectively unless stated otherwise on the Opulence in Travel website or in the Client’s bespoke proposal. Opulence in Travel will work with the Villa Owner or Owner’s Representative to try to accommodate the Client’s actual arrival and departure times, subject to availability. Please do advise Opulence in Travel of any changes to the Client’s schedule so every effort can be made to accommodate them.

Damage or Losses

A Property is typically someone’s home. Please treat the Property rented accordingly, and leave the Property and all its contents in good order and in an acceptably clean condition.

Any damage or losses caused during the Rental Period, as well as any special cleaning requirements will be the Client’s responsibility and may be charged to the Client’s account and deducted from the Client’s security deposit. In cases of excessive or unacceptable loss or damage at any time during the Rental Period, the Villa Owner or Owner’s Representative may require the Client and their party, including visitors to vacate the Property immediately, without compensation or refund.

Access

The Property and its facilities are available for the Client’s full enjoyment during the Rental Period. However Opulence in Travel staff, the Villa Owner, Owner’s Representative, or other staff and contractors may need access to the Property from time to time (e.g. for maintenance purposes to the house, garden, swimming pool, utilities and services, or for the purposes of providing additional services requested by the Client, etc.). The Client is required to give them reasonable access to the Property for these purposes.

Number of Client’s

The number of persons (adults and children) staying at the Property must not exceed the maximum number of sleeping places indicated on the Opulence in Travel website, in the bespoke proposal or on the booking confirmation, unless specifically authorized in writing. Exceeding this number may invalidate any insurance policy on the Property. Entry or access to the Property may be refused or limited where the number of Client’s exceeds the stated requirement. No pets are allowed unless agreed in writing in advance.

Use of Property

All bookings are assumed to be for normal holiday purposes only, and the Client’s agrees that the use of the Property will be limited to this purpose unless otherwise confirmed in writing.

If the Client is planning to hold an event, such as a wedding or party, which involves having a larger number of people at the Property, typically more than 50% of the approved number of Client’s in the Property, or if the Client is planning to use the Property for a purpose other than holiday, please communicate this to Opulence in Travel, as special approval or arrangements may be required. Depending on the nature of the event, a surcharge and/or additional security deposit may be required, which will be agreed and confirmed in writing prior to confirming the booking. Note that some Properties are in residential areas or estates, and some are subject to rules and regulations regarding their use. Therefore, it may not always be possible to grant permission for certain uses or activities due to these or other reasons beyond the control of Opulence in Travel, the Villa Owner or Owners representative.

If Opulence in Travel has confirmed a booking which includes an event at the Client’s chosen Property, in certain circumstances the Client must then obtain permits from the police and the local community before the event can proceed. The Client acknowledges and agrees that Opulence in Travel, the Villa Owner and the Owner’s Representative cannot control the issue of these permits. If the police and/or the local community refuse to issue a permit for an event at the Property, the Owner or the Owner’s Representative will refund any event fee paid by the Client to the Owner, however neither Opulence in Travel, the Villa Owner nor the Owner’s Representative will be liable for any further refund or payment to the Client.

Conduct and Due Care

Properties are generally located in quiet residential neighborhoods. The Client is asked to respect this, and ensure that all Client’s and visitors to the Property behave appropriately. Illegal or immoral activities including gambling, prostitution, prohibited drugs, possession or use of pyrotechnics or dangerous goods, and possession or use of firearms and other weapons are all strictly prohibited. Smoking is generally prohibited unless stated otherwise in the booking confirmation.

The Client is responsible for the behaviour of all the Client’s staying at the Property, as well as visitors to the Property during the Rental Period. Should any Client(s) or visitor(s) not behave in a suitable manner, the Villa Owner or Owner’s Representative may, in their absolute discretion, require the Client, their party and/or visitor(s) to leave the premises and/or vacate the Property immediately, without compensation or refund.
In the interests of safety, due care should be taken at the Property at all times, especially with children. Suitable supervision should be given around pools, beaches and roads, and when using all Property’s facilities.

Valuables and Security

Any Client valuables or Property left or used at the Property are at the Client’s own risk. Neither Opulence in Travel, the Villa Owner nor the Owner’s Representative accepts any responsibility for loss of or damage to Client Property. The Client is responsible for the Property during the Rental Period, and must ensure that all windows and doors are locked securely when not on the premises. Any act or omission by the Client, their party and/or visitors which may negate or prejudice the Property’s insurance policy and/or results in loss or damage is the Client’s responsibility.

Price Fluctuation

The price as confirmed in the booking confirmation once all monies have been received is fully guaranteed in the currency that was outlined in the bespoke proposal. Any exchange rate fluctuations will not be requested from the Client nor refunded to the Client.
Opulence in Travel reserves the right to impose any taxes or other charges which may be implemented by any government or other regulatory body, which were unknown at the time of publishing. Opulence in Travel will tell the Client promptly in the unlikely event that it becomes aware that any taxes or charges will apply to the Client’s booking.

Agency

Opulence in Travel acts as an agent only. Opulence in Travel offers a range of travel and bespoke services (which may include but are not limited to flights, accommodation, airport services, airport transfers, private yacht charters etc) on behalf of others who provide those services. Opulence in Travel’s duties to the Client are limited to arranging bookings on the Client behalf with those service providers. Opulence in Travel are not responsible for providing those services to the Client, or for the standard of any service provided, although all attempts will be made to ensure the higher service level is provided and all suppliers are handpicked by Opulence in Travel to ensure high service and quality levels.

If a service provider fails to provide the Client with a service, or if the Client is not satisfied with the standard of any service provided, the Client agrees that rights are directly against the service provider and not against Opulence in Travel, although all attempts will be made to negotiate on the Client’s behalf should the Client not be satisfied with the service provided by those service providers. The Client agrees that Opulence in Travel is not liable for any losses that the Client suffers in those circumstances, and that the Client will not claim against Opulence in Travel (directly or indirectly) any refund, credit or other dispute. The Client agrees that any money paid to Opulence in Travel will not be held on trust, but will be used by Opulence in Travel to make payment on the Client’s behalf to the service providers to secure the booking the Client’s travel ad bespoke services.

Insurance

It is a mandatory condition of the booking that the entire party is covered by comprehensive All Risk Travel Insurance (including cancellation, flight delays, loss and damage to baggage and other Property) and health insurance (including evacuation and repatriation coverage).

Opulence in Travel or the Property owner are held harmless by the Client and the Client’s party against all claims including any accidents related to the use of the Property facilities or locally procured third party services such as, but not limited to, watercraft, water sports, jeep or motorbike rental.

Opulence in Travel or the Property owner shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of Opulence in Travel or the Property owner’s control such as civil disturbances, fires, floods, severe weather, Acts of God, acts of Government etc.
By accepting this contract it is assumed by Opulence in Travel and the Property owner that this requirement has and will be complied with in full.

Amendments

Once a booking confirmation is issued by Opulence in Travel, there may be additional fees to make amendments to the booking. Opulence in Travel will do its best to accommodate any reasonable amendments, but the Client’s should be aware that some changes may not be possible. Please note that these amendment policies apply for regular booking periods. Special amendment terms may apply for peak/high seasons.

In the unlikely event that Opulence in Travel is unable for any reason (including the sale of a Property and force majeure) to provide the Client with the Property as booked by the Client, Opulence in Travel reserves the right to transfer the Client and their party to an alternative Property of the similar type and value, in consultation with the Client. If the price of the substituted Property is less than the original booking, the difference will be reimbursed to the Client. If the price of the substituted Property is higher than the original booking, the difference may be charged to the Client. If, however, after considerable effort by Opulence in Travel, no alternative of similar type and value is available and / or no agreement can be reached between the Client and Opulence in Travel, then either Opulence in Travel or the Client may opt to cancel the booking. In that event, Opulence in Travel will refund the Client all monies paid, without further compensation.

Complaints

Every attempt will be made for the Client to have an enjoyable stay. If the Client should have a problem during the Rental Period, please inform the Villa Owner or Owner’s Representative immediately who will endeavour to put things right. Should the Owner or Owner’s Representative not address the Client’s problem satisfactorily, please contact Opulence in Travel promptly. In order for the Client’s complaint to be addressed, the Client must communicate any problem whilst on location. If no complaint is reported during the Rental Period, Opulence in Travel and the Owner will assume that the Property was to the Client’s satisfaction and no complaint will be entertained.

Provisions

Self-catering accommodations require that the Client supply all provisions and consumables necessary for daily living. The staff at the Property may accommodate any reasonable requests to purchase provisions on the Client’s behalf, and this will be charged to the Client’s account.

Opulence in Travel’s Responsibility

The descriptions, assessments and/or ratings of Properties and surrounding locations that Opulence in Travel publishes or gives to the Client are provided in good faith and in the belief that they are accurate based on the latest information received and reference the Property website as provided in the Client bespoke quotation. However, Opulence in Travel cannot be held responsible for any modifications to the Properties or inaccuracies. Where Opulence in Travel publishes or refers to descriptions, assessments and/or ratings of the Property either by Opulence in Travel or by third parties, these ratings are for information purposes only and Opulence in Travel will not be held responsible for any reliance placed on these ratings.

Privacy Policy

Please refer to the Privacy Policy as outlined on the Opulence in Travel website.

Disclaimers

Neither Opulence in Travel, the Villa Owner nor the Owner’s Representative accepts any responsibility or liability for:

  • any physical injury, sickness, death, loss, damage, inconvenience or additional expenses incurred by the Client, their party or visitors regardless of the cause;
  • any vehicle or the contents of any vehicle used, hired or engaged by the Client or their party during the Rental Period; inability of the Client or any member of the Client’s party to enter the location of the Property or stay at the Property for all or part of the Rental Period as a result of failure to obtain appropriate travel or visa documentation, cancellation or amendments to travel arrangements or the missing of flights or travel connections; and/or
  • any delay or cancellation of the booking as a result of war, threat of war, riot or civil strife, strike, demonstration, terrorist activity (threatened or actual), natural disaster, fire, sickness, weather conditions, action at an airport or port by any government or public authority, technical problems relating to transport and airport regulations caused by technical, mechanical or electrical breakdowns, or any technical, structural, electrical, plumbing or other problems or difficulties with the Property which make it unsafe or unusable, or any other circumstances which amount to ‘force majeure’ or Acts of God, or other events beyond the Villa Owner’s control.
  • In no case will Opulence in Travel, the Villa Owner or the Owner’s Representative individually or collectively be liable to make any payment or give any refund or compensation of any amount over and above the total rental amount paid.

Jurisdiction

This agreement will be governed by the laws of Hong Kong SAR. In the event of controversy arising from the booking and Property rental that cannot be resolved amicably between the parties, both parties agree to exclusively refer the matter to the Singapore International Arbitration Centre to be resolved finally by arbitration in the English language.

By making its booking request, the Client agrees that these terms and conditions have been read, understood and have been accepted and agreed to by the Client without reservation and without exception.

If any of the terms and conditions outlined herein are or become or are deemed to be invalid, or if there is any omission from any terms and conditions, the remaining terms and conditions will remain valid and enforceable and cannot be contested.
